Terms of Use

These Terms of Use govern access to websites, systems, applications, and services owned, operated, or managed by AFScott LLC, including managed client environments where access is authorized.

1. Acceptance of Terms

By accessing or using any AFScott LLC website, platform, system, application, portal, or managed environment, you acknowledge that you have read, understood, and agree to these Terms of Use. If you do not agree, you must not access or use the applicable service or system.

2. Authorized Use

Users may access only those resources for which they have been properly authorized.

  • Use must be limited to legitimate business, support, administrative, or otherwise authorized purposes
  • Users must comply with applicable client policies, security requirements, and instructions
  • Access may be suspended, restricted, or revoked at any time where necessary to protect systems or data

3. Monitoring and Logging

All systems, services, applications, networks, and devices owned, operated, or managed by AFScott may be monitored, logged, recorded, reviewed, and audited for security, compliance, operational, support, training, and investigative purposes.

Monitoring may include authentication activity, session details, network traffic metadata, endpoint telemetry, system events, administrative actions, and other usage information relevant to system integrity and support operations.

By using systems or services covered by these Terms, you consent to monitoring, logging, and review. To the fullest extent permitted by law, users should have no expectation of privacy when using managed systems.

4. Security Responsibilities

  • Protect credentials, tokens, devices, and authentication methods from unauthorized use or disclosure
  • Comply with password, MFA, access control, endpoint protection, and security policy requirements
  • Promptly report suspected compromise, misuse, policy violations, or suspicious activity
  • Use only approved or authorized tools, software, and methods when interacting with managed systems

5. Acceptable Use Restrictions

Users may not:

  • Attempt to bypass security controls, access restrictions, logging mechanisms, or administrative safeguards
  • Introduce malware, malicious code, unauthorized scripts, or unapproved remote access tools
  • Use managed systems for unlawful, abusive, fraudulent, or clearly unauthorized purposes
  • Interfere with service availability, network integrity, or the security of any client or user environment

6. Service Availability

AFScott works to maintain stable and secure services, but uninterrupted availability is not guaranteed. Maintenance, upgrades, vendor dependencies, internet conditions, security events, or operational incidents may result in temporary interruption, degraded performance, or restricted access.

7. Client Agreements

If you are using services under a separate managed services agreement, statement of work, master services agreement, or similar contract, that agreement may supplement or control to the extent of any conflict with these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, AFScott LLC disclaims liability for indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to use of, inability to use, or unauthorized use of systems or services, including loss of data, interruption, delay, or third-party service failure.

Nothing in these Terms is intended to limit any liability that cannot be limited under applicable law.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules, unless a written client agreement expressly provides otherwise.

10. Changes to Terms

AFScott may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued access or use after changes are posted constitutes acceptance of the revised Terms.
